1. THE LINGO • “Brankova Hub" - space for providing co-working and other services, located in the building at the address: Brankova street 21A, floor 2, leased by and as a legal entity of Anna Iankova PR Beograd, registration number 66519538, tax number 113029152, address: Brankova street 21A, floor 2, Belgrade, Serbia. • “Premises” means the Premises in which the Brankova Hub is located, as set forth in the Membership Details form. • "Client" - individual or legal entity/entrepreneur, who has access to the Premises and uses Brankova Hub services based on this Agreement. • "Services" - a set of services for organizing the workspace of the Brankova Hub, which the Hub provides to the Client in accordance with the terms of the Agreement. • "Workplace" means a fixed workplace or a vacant workplace. • "Tariff" - the standard commercial offer of the Brankova Hub, which indicates the list of the services provided by the Hub, their price, terms and procedure for their provision. • “Terms & Conditions” equals in its meaning to the “Agreement with a Client”. 2. THE AGREEMENT 2.1 The Brankova Hub, for a fee, provides the Services under the Agreement in accordance with the Tariff selected by the Client and stated in the Membership details form, and the Client undertakes to accept and pay for the Services. 2.2 Duration: This agreement lasts for the period stated in Membership details form. 2.3 Term Commencement date of the agreement: The obligations as per this agreement will commence from the date stated in the Membership details form, and to clarify, these obligations are independent of actual occupation/ use of the premises by the Client or its representatives. 2.4 Confidentiality: The terms of this Agreement are confidential. Neither the Client nor Brankova Hub may disclose them without the other party’s consent unless required to do so by law or an official authority. This obligation continues after this Agreement ends. 2.5 Jurisdiction: Civil Courts of the city in which Brankova Hub is located shall have exclusive jurisdiction in the event any disputes or differences arise in respect of, out of, relating to and/ or touching this Agreement. This agreement is interpreted and enforced in accordance with the law of the place where Brankova Hub is located. |
1. DEFINICIJE • "Brankova Hub" - prostor koji pruža usluge kouorkinga i drugih usluga, smešten u zgradi na adresi: Brankova ulica 21A, sprat 2, zakupljen od strane i kao pravno lice Anna Iankova PR Beograd, registarski broj 66519538, poreski broj 113029152, adresa: Brankova ulica 21A, sprat 2, Beograd, Srbija. • "Prostorije" označavaju prostorije u kojima se nalazi Brankova Hub, kako je navedeno u obrascu za detalje članstva. • "Klijent" - fizičko lice ili pravno lice/preduzetnik, koji ima pristup prostorijama i koristi usluge Brankova Hub-a na osnovu ovog Ugovora. • "Usluge" - skup usluga za organizaciju radnog prostora Brankova Hub-a, koje Hub pruža Klijentu u skladu sa uslovima ovog Ugovora. • “Radno mesto" označava fiksno radno mesto ili slobodno radno mesto. • "Tarifa" - standardna komercijalna ponuda Brankova Hub-a, koja sadrži listu usluga koje Hub pruža, njihovu cenu, uslove i postupak za njihovo pružanje. • "Uslovi i odredbe" imaju isto značenje kao i "Ugovor sa Klijentom”. 2. UGOVOR 2.1 Brankova Hub, uz naknadu, pruža Usluge prema Ugovoru u skladu sa Tarifom koju je izabrao Klijent i navedenom u Formi za detalje članstva, a Klijent se obavezuje da prihvati i plati za Usluge. 2.2 Trajanje: Ovaj ugovor traje za period naveden u Formi za detalje članstva. 2.3 Datum početka trajanja ugovora: Obaveze prema ovom ugovoru počeće od datuma navedenog u Formi za detalje članstva, i da se razjasni, ove obaveze su nezavisne od stvarne zauzetosti/upotrebe prostorija od strane Klijenta ili njegovih predstavnika. 2.4 Poverljivost: Uslovi ovog ugovora su poverljivi. Nijedna strana, ni Klijent ni Brankova Hub, ne sme ih otkriti bez saglasnosti druge strane, osim ako to zahteva zakon ili službeni organ. Ova obaveza ostaje i nakon završetka ovog ugovora. 2.5 Nadležnost: Građanski sudovi grada u kojem se nalazi Brankova Hub imaće isključivu nadležnost u slučaju nastanka sporova ili nesuglasica u vezi sa ovim ugovorom. Ovaj ugovor se tumači i sprovodi u skladu sa zakonom mesta gde se nalazi Brankova Hub. |
2.6 Costs: The Client must also pay all reasonable costs relating to this Agreement, including any legal costs whatsoever, and any Bank charges payable by Brankova Hub in respect of the Fee and other amounts received by Brankova Hub from the Client pursuant to this Agreement. 2.7 Notices: All formal notices must be in writing and: • shall be deemed to have been served on the Client if delivered to the Premises or posted to the last known address of the Client and in the latter case shall be deemed to have been served on the third working day after posting. It is expected of the Client that they keep their communication address updated with Brankova Hub at all times. • shall be deemed to have been served on Brankova Hub if delivered to the reception of Brankova Hub where the Client has taken premises or posted to the address of Brankova Hub and in latter case shall be deemed to have been served on the third working day after posting. 2.8 Insurance: It is the Client’s responsibility to arrange insurance of its own property which it brings in to Brankova Hub and for its own liability to its employees and to third parties. 3. THE PACKAGES 3.1 Virtual Address The services under this tariff represent the use by the Client of the address of Brankova Hub, and include the following: • registration of the company at the address (lease of the address); • allocation of a mailbox and reception of mail; • notification of the user about received shipments by e-mail or by telephone. 3.2 Day Pass The services under this tariff represent the use by the Client of the workspace of Brankova Hub for a one day, and include the following: • provision of a 1 free table, chairs; • use of space for relaxation and informal communication (non-working zones); • use of fast internet connection, office equipment.
3.3 Hot desk The services under this tariff represent the use by the Client of the workspace of Brankova Hub, and include the following: • provision of a 1 free table, chairs – 10 days a month; • access to the Premises 24 hours a day any day of the week (24/7); • use of fast internet connection, office equipment; • cleaning of the workplace up to 3 times a week (wet cleaning, garbage removal).

2.6 Troškovi: Klijent mora platiti sve razumne troškove koji se odnose na ovaj Ugovor, uključujući sve pravne troškove i sve naknade za banku koje treba platiti Brankova Hub u vezi sa naknadom i drugim iznosima koje Brankova Hub prima od Klijenta prema ovom Ugovoru.
2.7 Obaveštenja: Sva zvanična obaveštenja moraju biti u pisanoj formi i: • Smatraće se da su dostavljena Klijentu ako su dostavljena na Prostorije ili poslata na poslednju poznatu adresu Klijenta, a u ovom drugom slučaju smatraće se da su dostavljena trećeg radnog dana nakon slanja. Očekuje se od Klijenta da redovno ažurira svoju adresu komunikacije sa Brankova Hub-om. • Smatraće se da su dostavljena Brankova Hub-u ako su dostavljena na recepciju Brankova Hub-a gde Klijent ima prostorije ili poslata na adresu Brankova Hub-a, a u ovom drugom slučaju smatraće se da su dostavljena trećeg radnog dana nakon slanja. 2.8 Osiguranje: Odgovornost Klijenta je da organizuje osiguranje svoje imovine koju unosi u Brankova Hub i za svoju odgovornost prema svojim zaposlenima i trećim licima.
3. TARIFE 3.1 Virtuelna Adresa Usluge pod ovom tarifom predstavljaju korišćenje adrese Brankova Hub-a od strane Klijenta, i obuhvataju sledeće: • registraciju kompanije na toj adresi (zakup adrese); • dodelu poštanskog sandučeta i prijem pošte; • obaveštenje korisnika o primljenim pošiljkama putem e-maila ili telefona. 3.2 Dnevna Karta Usluge pod ovom tarifom predstavljaju korišćenje radnog prostora Brankova Hub-a od strane Klijenta tokom jednog dana, i obuhvataju sledeće: • obezbeđenje 1 slobodnog stola, stolica; • korišćenje prostora za opuštanje i neformalnu komunikaciju (zone van radnog vremena); • korišćenje brze internet veze, kancelarijske opreme. 3.3 Fleksibilni Radni Sto Usluge pod ovom tarifom predstavljaju korišćenje radnog prostora Brankova Hub-a od strane Klijenta, i obuhvataju sledeće: • obezbeđenje 1 besplatnog stola, stolica - 10 dana mesečno; • pristup prostorijama 24 sata dnevno svakog dana u nedelji (24/7); • korišćenje brze internet veze, kancelarijske opreme; • čišćenje radnog mesta do 3 puta nedeljno (mokro čišćenje, odnošenje smeća). |
3.4 Premium The services under this tariff represent the use by the Client of the workspace of Brankova Hub, and include the following: • provision of a reserved table, chair; • access to the Premises 24 hours a day any day of the week (24/7); • use of fast internet connection, office equipment; • cleaning the workplace once a day (wet cleaning, garbage removal).
4. FEES & PAYMENTS 4.1 Set-Up Fee: The Set-Up Fee stated in the Membership details form shall be payable monthly in advance, no later than the 5th day of each and every month, to Brankova Hub. Fee for the Virtual Address tariff is due to be paid for a period of not less than 3 months in advance 4.2 Payment under this Agreement is made in dinars of the Republic of Serbia, and payment obligations are considered fulfilled by the Client at the moment of receipt of the entire amount of money to Brankova Hub account. In the event that the Services are paid in cash, the payment obligations are considered fulfilled from the moment of depositing cash in Brankova Hub cash register. 4.3. Services paid for, but not used by the Client within the established terms, are considered as have been provided, their cost is not refunded. The Client accepts and understands that Brankova Hub, when confirming the Client's Application, reserves for him the required number of Services in Brankova Hub, which are not provided to other Clients during the provision of Services. 4.4 Additional Services: Brankova Hub may provide additional Services directly or through a business affiliate. Such Services will be billed in arrears at the end of the month, as per usage, and are due within 7 days from the date of the invoice. Fees for such Services, plus applicable taxes, will be applicable in accordance with Brankova Hub published rates which may change from time to time. 4.5 Renewal: Brankova Hub may increase the Set-up fee no more than once per each year of contracting with a Client and not earlier than in the last month of the agreement period for further agreement extension. 4.6 Invoice disputes: In case of any dispute in any charges, the Client must notify Brankova Hub in writing of such disputed amount and the reasons for it within 7 days of the date of the invoice. The Client must pay the amount not in dispute by the due date or be subject to late fees. Brankova Hub and the Client will endeavour to resolve, by mutual discussion, the disputed portion of the charges for Services within one week of receiving a notice from the Client. 4.7 Late Payment: In the event of delay in making payment of the Set-up Fee or Services, the Client shall be liable to pay “default-interest” on the amount due at the rate of 5% per month. The Client shall bear all bank charges. Brankova Hub reserves the right to withhold services (including for the avoidance of doubt, denying the Client access to its premises, where applicable) while there are any outstanding fees and/or interest or the Client is in breach of this Agreement.

3.4 Premium Usluge pod ovom tarifom predstavljaju korišćenje radnog prostora Brankova Hub-a od strane Klijenta, i obuhvataju sledeće: • obezbeđenje rezervisanog stola, stolice; • pristup prostorijama 24 sata dnevno svakog dana u nedelji (24/7); • korišćenje brze internet veze, kancelarijske opreme; • čišćenje radnog mesta jednom dnevno (mokro čišćenje, odnošenje smeća). 4. TROŠKOVI I PLAĆANJA 4.1 Zakupnina: Zakupnina navedena u Formi za detalje članstva i plaća se mesečno unapred, najkasnije do 5. dana svakog meseca, Brankova Hub-u. Taksa za tarifu Virtuelne adrese treba biti plaćena za period od najmanje 3 meseca unapred. 4.2 Plaćanje prema ovom ugovoru vrši se u dinarima Republike Srbije, a obaveze plaćanja smatraju se ispunjenim trenutkom prijema celokupnog iznosa novca na račun Brankova Hub-a od strane Klijenta. U slučaju plaćanja usluga gotovinom, obaveze plaćanja smatraju se ispunjenim trenutkom uplate gotovine u kasi Brankova Hub-a. 4.3 Usluge koje su plaćene, ali nisu korišćene od strane Klijenta u utvrđenim rokovima, smatraju se pruženim, i njihov trošak se ne refundira. Klijent prihvata i razume da Brankova Hub, potvrđujući Aplikaciju Klijenta, rezerviše za njega potreban broj usluga u Brankova Hub-u, koje se ne pružaju drugim Klijentima tokom pružanja Usluga. 4.4 Dodatne Usluge: Brankova Hub može pružiti dodatne usluge direktno ili putem poslovnih partnera. Takve usluge će se naplaćivati naknadno na kraju meseca, prema korišćenju, i dospeće je u roku od 7 dana od datuma fakture. Naknade za takve usluge, uz primenljive poreze, primenjivaće se prema objavljenim tarifama Brankova Hub-a koje se mogu menjati s vremena na vreme. 4.5 Povećanje: Brankova Hub može povećati naknadu za otvaranje ne više od jednom godišnje ugovaranja sa Klijentom i ne ranije od poslednjeg meseca perioda ugovora za dalje produženje ugovora. 4.6 Sporovi oko fakture: U slučaju bilo kakvog spora u vezi sa bilo kojim troškom, Klijent mora pismeno obavestiti Brankova Hub o spornom iznosu i razlozima u roku od 7 dana od datuma fakture. Klijent mora platiti iznos koji nije sporan do datuma dospeća ili će biti podložan kašnjenju sa kamatom. Brankova Hub i Klijent će se truditi da reše sporni deo troškova za Usluge u roku od jedne nedelje od prijema obaveštenja od strane Klijenta. 4.7 Kašnjenje u plaćanju: U slučaju kašnjenja u plaćanju naknade za otvaranje ili usluga, Klijent je dužan platiti "zakonsku kamatu" na iznos duga po stopi od 5% mesečno. Klijent snosi sve bankarske troškove. Brankova Hub zadržava pravo da zadrži usluge (uključujući, radi izbegavanja sumnje, uskraćivanje pristupa Klijentu njegovim prostorijama, ako je primenljivo) dok postoje neizmirene naknade i/ili kamata ili dok Klijent ne prekrši ovaj Ugovor. |
5. RIGHTS & OBLIGATIONS Brankova Hub undertakes: 5.1 Execution of this Agreement from the moment of its conclusion. 5.2 Providing access to the Client to Brankova Hub. 5.3 Maintaining Premises where Brankova Hub is located in proper sanitary, fireproof and technical condition. 5.4 Taking care of the cleaning of the Premises, including dry and wet cleaning of the floors, removal of garbage, replacement of plastic bags, removal of dust from surfaces on a regular basis. 5.5 Providing access to a fast Internet connection. 5.6 Not to distribute confidential information obtained from the Client, and which Brankova Hub received during the execution of this Agreement, unless otherwise provided by the legislation of the Republic of Serbia. Brankova Hub has the right to: 5.7. The Coworking has the right to unilaterally amend the Agreement, except for the point 4.5 of this Agreement, by notifying the Client at least 7 (seven) calendar days in advance or publishing of the new text of the Agreement on Brankova Hub website. 5.8. Restrict visitors' access to Brankova Hub if they do not comply with the Rules of Visiting. 5.9 Install a video surveillance system in Brankova Hub to prevent theft or damage to the property of Clients of Brankova Hub. 5.10 Completely or partially terminate the provision of Services if it is necessary to carry out technical or sanitary-hygienic measures. At the same time, the period for providing Services under this Agreement is extended for the period necessary to perform the activities specified in this subparagraph. The Client undertakes to: 5.11 Complete the initial registration procedure provided for in the Rules for visiting Brankova Hub. 5.12 Adhere to the sanitary and hygienic rules, rules of fire protection, safety and health provided by the legislation of the Republic of Serbia. 5.13 Provide all documents, pertaining to the identification of the Company or of the person, as deemed relevant by Brankova Hub. 5.14 Within 3 (three) calendar days from the date of data change (contact data), notify Brankova Hub in writing about such changes. 5.15 Use the property of Brankova Hub exclusively for its purpose. 5.16 Compensate Brankova Hub for all losses caused by |
5. PRAVA I OBAVEZE Brankova Hub se obavezuje: 5.1 Izvršavanje ovog ugovora od trenutka njegovog zaključenja. 5.2 Omogućavanje pristupa Klijentu Brankova Hub-u. 5.3 Održavanje prostorija gde se nalazi Brankova Hub u odgovarajućem sanitarnom, protivpožarnom i tehničkom stanju. 5.4 Briga o čišćenju prostorija, uključujući suvo i mokro čišćenje podova, uklanjanje smeća, zamenu plastičnih kesa, redovno uklanjanje prašine sa površina. 5.5 Omogućavanje pristupa brzoj internet vezi. 5.6 Ne distribuirati poverljive informacije dobijene od Klijenta, a koje je Brankova Hub dobio tokom izvršenja ovog ugovora, osim ako to nije drugačije predviđeno zakonodavstvom Republike Srbije. Brankova Hub ima pravo: 5.7. Hub ima pravo da jednostrano izmeni Ugovor, osim tačke 4.5 ovog Ugovora, obaveštavajući Klijenta najmanje 7 (sedam) kalendarskih dana unapred ili objavljivanjem novog teksta Ugovora na veb-sajtu Brankova Hub-a. 5.8. Ograničiti pristup posetiocima Brankova Hub-a ako se ne pridržavaju Pravila posete. 5.9. Postaviti sistem video nadzora u Brankova Hub-u radi sprečavanja krađe ili oštećenja imovine Klijenata Brankova Hub-a. 5.10. Potpuno ili delimično obustaviti pružanje usluga ako je potrebno sprovesti tehničke ili sanitarno-higijenske mere. Istovremeno, rok za pružanje usluga prema ovom ugovoru se produžava za period potreban za izvođenje aktivnosti navedenih u ovom podstavku.
Klijent se obavezuje: 5.11. Završiti početni postupak registracije predviđen Pravilima posete Brankova Hub-u. 5.12. Pridržavati se sanitarno-higijenskih pravila, pravila zaštite od požara, bezbednosti i zdravlja propisanih zakonodavstvom Republike Srbije. 5.13. Pružiti sve dokumente koji se odnose na identifikaciju Kompanije ili osobe, prema proceni Brankova Hub-a. 5.14. U roku od 3 (tri) kalendarska dana od dana promene podataka (kontaktnih podataka), pismeno obavestiti Brankova Hub o takvim promenama. 5.15. Koristiti imovinu Brankova Hub-a isključivo za njenu namenu. 5.16 Nadoknaditi Brankova Hubu sve gubitke |
him in connection with the violation of this Agreement and the Rules of visiting, fire protection, other rules of Brankova Hub and causing property damage. 5.17 Not disturb other clients of Brankova Hub, including their representatives and guests. 5.18 Not to smoke in the office nor consume alcoholic beverages in the premises or any part thereof. 5.19 Compliance: The Client must comply with all relevant laws and regulations in the conduct of its business. The Client must do nothing illegal in connection with its use of Brankova Hub. The Client must not do anything that may interfere with the use of Brankova Hub by others, cause of nuisance or annoyance, increase of the insurance Brankova Hub has to pay, or cause loss or damage to Brankova Hub (including damage to reputation) or to the owner of any interest in the building which contains premises the Client is using. 6. TERMINATION 6.1 This Agreement shall be terminated on the following date after a duration period stated in the Membership details form expires. 6.2 As an exception to the rule 6.1 of the Agreement, if the Client continues to undertake payment obligations and pays Set-up fees in due period, the Agreement shall be considered as extended on the same conditions for the same period. 6.3 Ending this agreement immediately: Brankova Hub may put an end to this agreement immediately, to withhold Services and re- enter the Premises by giving the Client notice and without need to follow any additional procedure, if: • the Client becomes insolvent, bankrupt, goes into liquidation or becomes unable to pay its debts as they fall due, or • the Client is in its breach of one of its obligations, including but not limited to payment of Set-up Fees and Services Due, which cannot be put right or the Client has failed to put right within fourteen days (14) of that notice, or • the Client defaults in vacating the premises when this agreement has ended. The Client is responsible for any loss, claim or liability Brankova Hub incurs as a result of the Client’s failure to vacate on time. Brankova Hub will also be at liberty to remove the articles and belongings of the Client from the premises at the risk and cost of the Client. • Force Majeure: In the event the premises are destroyed or damaged, at any time, by any event falling within the term “force majeure”, this Agreement shall come to an end on Brankova Hub giving to the Client notice in writing to that effect. Brankova Hub shall within two weeks of giving notice that this Agreement has come to an end for the reasons aforesaid and refund to the Client the fees paid by the Client after adjusting therefrom all dues under any head for the past period. |
prouzrokovane od strane Klijenta u vezi s kršenjem ovog Ugovora i Pravila posete, pravila zaštite od požara, drugih pravila Brankova Huba i prouzrokovanih oštećenja imovine. 5.17 Ne remetiti druge klijente Brankova Hub-a, uključujući njihove predstavnike i goste. 5.18 Zabranjeno je pušenje i konzumiranje alkoholnih pića u kancelariji ili bilo kojem njenom delu. 5.19 Usklađenost: Klijent mora poštovati sve relevantne zakone i propise u vođenju svog poslovanja. Klijent ne sme činiti ništa nezakonito u vezi s korišćenjem Brankova Hub-a. Klijent ne sme preduzimati ništa što bi moglo ometati korišćenje Brankova Hub-a od strane drugih, prouzrokovati uznemiravanje, povećati osiguranje koje Brankova Hub mora platiti ili prouzrokovati gubitak ili oštećenje Brankova Hub-a (uključujući oštećenje reputacije) ili vlasnika bilo kakvog interesa u zgradi koja sadrži prostorije koje Klijent koristi. 6. RASKID 6.1 Ovaj ugovor će biti raskinut na datum koji dolazi nakon isteka perioda trajanja navedenog u Formi za detalje članstva. 6.2 Kao izuzetak od pravila iz tačke 6.1 Ugovora, ukoliko Klijent nastavi s izvršavanjem obaveza plaćanja i plaća naknade za postavljanje u odgovarajućem roku, Ugovor će se smatrati produženim pod istim uslovima i za isti period. 6.3 Neposredni prestanak ovog ugovora: Brankova Hub može odmah okončati ovaj ugovor, obustaviti pružanje usluga i ponovo ući u prostorije dajući Klijentu obaveštenje i bez potrebe za dodatnim postupkom, ako: • Klijent postane nesolventan, bankrotira, likvidira se ili postane nesposoban da izmiruje svoje dugove kako dolaze do dospelosti, ili • Klijent prekrši jednu od svojih obaveza, uključujući, ali ne ograničavajući se na plaćanje naknada za postavljanje i usluga koje duguje, a što se ne može ispraviti ili Klijent nije ispravio u roku od četrnaest dana (14) od tog obaveštenja, ili • Klijent ne isprazni prostorije kada je ovaj ugovor završen. Klijent je odgovoran za svaki gubitak, zahtev ili odgovornost koju Brankova Hub preuzme zbog neuspeha Klijenta da blagovremeno napusti prostor. Brankova Hub takođe ima pravo da ukloni predmete i stvari Klijenta iz prostorija na rizik i trošak Klijenta. • Viša sila: U slučaju da prostorije budu uništene ili oštećene u bilo koje vreme, zbog bilo kojeg događaja koji spada u termin "viša sila", ovaj ugovor će prestati na osnovu obaveštenja Brankova Hub-a Klijentu u pisanom obliku. Brankova Hub će u roku od dve nedelje od davanja obaveštenja da je ovaj ugovor prestao iz navedenih razloga i vratiti Klijentu naknade koje je Klijent platio nakon što se odatle priznaju sve dospelosti iz bilo kog naslova za protekli period. |
6.4 The Client shall cease to use and occupy the premises on the expiry or sooner termination of this Agreement; remove all its equipment, belongings, articles and things and its employees / personnel and to vacate and hand back the premises and at the same time all keys and access cards. 6.5 The Client must leave the premises in the same condition as it was when the Client took it. Brankova Hub reserves the right to charge additional reasonable fees for any repairs needed above and beyond normal wear and tear. 7. LIABILITY & DISCLAIMER 7.1 Brankova Hub will not in any circumstances have any liability for loss of business, loss of profits, loss of anticipated savings, loss of or damage to data, third party claims or any consequential loss unless Brankova Hub otherwise agrees in writing. 7.2 Subject to gross negligence and deliberate misconduct, Brankova Hub, its employees and agents shall not be held responsible for any theft, loss or damage from the Premises, unless other is stated by the court decision after relevant proceedings. 7.3 Brankova Hub shall not be responsible for any loss, damage, corruption of data or any loss of information whether from hardware, software or internet damage that may occur to the Client during the term of this agreement. Brankova Hub shall not be responsible for any loss, damage or loss of information resulting from communications or data failure including voice, communication and the internet. 7.4 The Client acknowledges that Agreement is subject to the Head-lease under which Brankova Hub holds the Premises. The parties agree that this Agreement is dependent and conditional upon the Head-lease and that if the Head-lease is terminated for any reason, this Agreement shall also immediately terminate without prejudice to any antecedent rights. 7.5. Data Privacy Consent. In order to administer this Agreement Brankova Hub may process any and all personal or professional data, including but not limited to ID number, home address and telephone number, date of birth and other information that is necessary or desirable for the administration of this Agreement (the "Relevant Information"). By entering into this Agreement, the Client • authorizes Brankova Hub to collect, process, register and transfer all Relevant Information; • waives any privacy rights the Client may have with respect to the Relevant Information; • authorizes Brankova Hub to store and transmit such information in electronic form. The Client shall have access to, and the right to change, the Relevant Information. Relevant Information will only be used in accordance with applicable law. |
6.4 Klijent će prestati koristiti i zauzimati prostorije na isteku ili ranijem raskidu ovog ugovora; ukloniti svu svoju opremu, stvari, artikle i stvari, kao i svoje zaposlene/osoblje, isprazniti prostor i vratiti ga, istovremeno vratiti sve ključeve i kartice za pristup. 6.5 Klijent mora ostaviti prostorije u istom stanju u kojem su bile kada ih je Klijent preuzeo. Brankova Hub zadržava pravo naplate dodatnih razumnih naknada za bilo kakve popravke koje su potrebne iznad normalnog habanja. 7. ODGOVORNOST I OBAVEŠTENJA 7.1 Brankova Hub neće, ni u kojim okolnostima, biti odgovoran za gubitak poslovanja, gubitak dobiti, gubitak očekivane uštede, gubitak ili oštećenje podataka, potraživanja trećih lica ili bilo kakav posledični gubitak, osim ako Brankova Hub drugačije ne dogovori pismeno. 7.2 Pod uslovom grubog nemara i namernog postupanja, Brankova Hub, njegovi zaposleni i agenti neće biti odgovorni za krađu, gubitak ili oštećenje iz prostorija, osim ako sud odluči drugačije nakon relevantnih postupaka. 7.3 Brankova Hub neće biti odgovoran za gubitak, oštećenje, korupciju podataka ili bilo kakav gubitak informacija, bilo da je reč o hardveru, softveru ili oštećenju interneta koji može nastati Klijentu tokom trajanja ovog ugovora. Brankova Hub neće biti odgovoran za gubitak, oštećenje ili gubitak informacija koji proizlaze iz kvarova komunikacije ili podataka, uključujući glasovne komunikacije i internet. 7.4 Klijent priznaje da je ovaj ugovor predmet glavnog zakupa pod kojim Brankova Hub drži prostorije. Strane se slažu da je ovaj ugovor zavisan i uslovljen glavnim zakupom i da će, ukoliko glavni zakup bude raskinut iz bilo kog razloga, ovaj ugovor takođe odmah prestati, bez narušavanja prethodnih prava. 7.5. Saglasnost o privatnosti podataka. U cilju sprovođenja ovog Ugovora, Brankova Hub može obrađivati sve lične ili profesionalne podatke, uključujući, ali ne ograničavajući se na broj lične karte, adresu i broj telefona, datum rođenja i druge informacije koje su neophodne ili poželjne za administraciju ovog Ugovora ("Relevantne informacije"). Ulaskom u ovaj Ugovor, Klijent: • ovlašćuje Brankova Hub da prikuplja, obrađuje, evidentira i prenosi sve Relevantne informacije; • odriče se bilo kakvih prava na privatnost koje Klijent može imati u vezi sa Relevantnim informacijama; • ovlašćuje Brankova Hub da skladišti i prenosi takve informacije u elektronskom obliku. Klijent ima pristup i pravo da promeni Relevantne informacije. Relevantne informacije će se koristiti samo u skladu sa važećim zakonom. |
